# §217.343. Prohibitions.


Except for the takings described in [§ 217.342](/cfr/50/217.342.md) and authorized by the LOA issued under this subpart, it is unlawful for any person to do any of the following in connection with the activities described in this subpart:

- (a) Violate, or fail to comply with, the terms, conditions, and requirements of this subpart or the LOA issued under this subpart.
- (b) Take any marine mammal not specified in [§ 217.342(d)](/cfr/50/217.342.md?p=d).
- (c) **Take any marine mammal specified in the LOA in any manner other than as specified in the LOA.**
- (d) Take any marine mammal specified in [§ 217.342(d)](/cfr/50/217.342.md?p=d), after National Marine Fisheries Service (NMFS) Office of Protected Resources determines such taking results in more than a negligible impact on the species or stocks of such marine mammals.
