# §217.323. Prohibitions.


Except for the takings described in [§ 217.322](/cfr/50/217.322.md) and authorized by a LOA issued under [§ 217.326](/cfr/50/217.326.md) or [§ 217.327](/cfr/50/217.327.md), it is unlawful for any person to do any of the following in connection with the activities described in this subpart:

- (a) Violate, or fail to comply with, the terms, conditions, and requirements of this subpart or a LOA issued under this subpart;
- (b) Take any marine mammal not specified in [§ 217.322(d)](/cfr/50/217.322.md?p=d);
- (c) Take any marine mammal specified in [§ 217.322(d)](/cfr/50/217.322.md?p=d) in any manner other than as specified in § [217.322(a)](/cfr/50/217.322.md?p=a) and [(b)](/cfr/50/217.322.md?p=b); or
- (d) Take any marine mammal specified in [§ 217.322(d)](/cfr/50/217.322.md?p=d), after NMFS Office of Protected Resources determines such taking results in more than a negligible impact on the species or stocks of such marine mammals.
