# §217.313. Prohibitions.


Except for the takings described in [§ 217.312](/cfr/50/217.312.md) and authorized by a LOA issued under [§ 217.316](/cfr/50/217.316.md) or [§ 217.317](/cfr/50/217.317.md), it is unlawful for any person to do any of the following in connection with the activities described in this subpart.

- (a) Violate or fail to comply with the terms, conditions, and requirements of this subpart or a LOA issued under §§ [217.316](/cfr/50/217.316.md) and [217.317](/cfr/50/217.317.md).
- (b) Take any marine mammal not specified in [§ 217.312(c)](/cfr/50/217.312.md?p=c).
- (c) Take any marine mammal specified in [§ 217.312(c)](/cfr/50/217.312.md?p=c) in any manner other than specified in § [217.312(a)](/cfr/50/217.312.md?p=a) and [(b)](/cfr/50/217.312.md?p=b).
- (d) Take any marine mammal, as specified in [§ 217.312(c)](/cfr/50/217.312.md?p=c), after NMFS determines such taking results in more than a negligible impact on the species or stocks of such marine mammals.
