# §217.273. Prohibitions.


Except for the takings described in [§ 217.272](/cfr/50/217.272.md) and authorized by an LOA issued under §§ [217.276](/cfr/50/217.276.md) or [217.277](/cfr/50/217.277.md), it is unlawful for any person to do any of the following in connection with the activities described in this subpart:

- (a) Violate or fail to comply with the terms, conditions, and requirements of this subpart or an LOA issued under §§ [217.276](/cfr/50/217.276.md) and [217.277](/cfr/50/217.277.md);
- (b) Take any marine mammal stock not specified in [§ 217.272(d)](/cfr/50/217.272.md?p=d);
- (c) Take any marine mammal stock specified in the LOA in any manner other than as specified in the LOA; or
- (d) Take any marine mammal stock specified in [§ 217.272(d)](/cfr/50/217.272.md?p=d) after National Marine Fisheries Service (NMFS) Office of Protected Resources determines such taking results in more than a negligible impact on the stock of marine mammals.
