# §217.192. Permissible methods of taking.


Under LOAs issued pursuant to [§§ 216.106](/cfr/50/216.106.md) of this chapter and 217.196, the Holder of the LOA (hereinafter “Coast Guard”) may incidentally, but not intentionally, take marine mammals within the areas described in [§ 217.190(b)](/cfr/50/217.190.md?p=b) by Level A or Level B harassment associated with maintenance construction activities, provided the activity is in compliance with all terms, conditions, and requirements of the regulations in this subpart and the appropriate LOA.
