# §217.162. Permissible methods of taking.


Under an LOA issued pursuant to [§§ 217.106](/cfr/50/217.106.md) of this chapter and 217.166, the holder of the LOA (hereinafter “Hilcorp”) may incidentally, but not intentionally, take marine mammals within the specified geographical region described in [§ 217.160(b)](/cfr/50/217.160.md?p=b) by harassment associated with the specified activities provided they are in compliance with all terms, conditions, and requirements of the regulations in this subpart and the applicable LOA.
