# §511.202. Authority of agency.


Subject to the provisions of [subpart F](/cfr/5/subpartF.md) of this part and [§ 511.203](/cfr/5/511.203.md), an agency may determine whether a position is subject to, or is excluded from, chapter 51 of title 5, United States Code, by [section 5102(c)](/cfr/5/5102.md?p=c) (7) and (8) thereof.
