# §359.407. Appeals.

- (a) Removal under § [359.402](/cfr/5/359.402.md), [359.403](/cfr/5/359.403.md), or [359.404](/cfr/5/359.404.md) is not appealable to the Merit Systems Protection Board under [5 U.S.C. 7701](/usc/5/7701.md).
- (b) Removal under [§ 359.405](/cfr/5/359.405.md) is appealable to the Merit Systems Protection Board under [5 U.S.C. 7701](/usc/5/7701.md) as to whether the reduction in force complies with the competitive procedures required under [5 U.S.C. 3595(a)](/usc/5/3595.md?p=a).
