# §302.108. Determinations of fitness for employment in an Excepted Service position.

- (a) An agency must make fitness determinations for excepted service positions in accordance with the applicable requirements of [part 731](/cfr/5/part731.md) of this chapter.
- (b) An agency must record its reasons for making fitness determinations under [part 731](/cfr/5/part731.md) of this chapter and must furnish a copy of those reasons to an applicant upon their request.
