# §655.3. Applicability.

- (a) Except as specifically excluded in paragraphs [(b)](#b), and [(c)](#c) of this section, this part applies to:
  - (1) Each recipient and subrecipient receiving Federal assistance under 49 U.S.C. [5307](/usc/49/5307.md), [5309](/usc/49/5309.md), or [5311](/usc/49/5311.md); and
  - (2) Any contractor of a recipient or subrecipient of Federal assistance under 49 U.S.C. [5307](/usc/49/5307.md), [5309](/usc/49/5309.md), [5311](/usc/49/5311.md).
- (b) A recipient operating a railroad regulated by the Federal Railroad Administration (FRA) shall follow [49 CFR Part 219](/cfr/49/part219.md) and [§ 655.83](/cfr/49/655.83.md) for its railroad operations, and shall follow this part for its non-railroad operations, if any.
- (c) A recipient operating a ferryboat regulated by the United States Coast Guard (USCG) that satisfactorily complies with the testing requirements of 46 CFR Parts [4](/cfr/46/part4.md) and [16](/cfr/46/part16.md), and [33 CFR Part 95](/cfr/33/part95.md) shall be in concurrent compliance with the testing requirements of this part. This exception shall not apply to the provisions of [section 655.45](/cfr/49/655.45.md), or subparts [G](/cfr/49/subpartG.md), or [H](/cfr/49/subpartH.md) of this part.
