# §29.930. May the Department or the Tribe appeal the decision of an administrative law judge?

- (a) The decision of an administrative law judge is a recommended decision that the Department or the Tribe may appeal to the Secretary.
- (b) The decision of an administrative law judge becomes the final decision of the Secretary 60 days after it is served on the Department and the Tribe unless a petition for review is filed in accordance with [§ 29.931](/cfr/49/29.931.md). The decision of the Secretary is a final agency action that the Tribe may appeal to the U.S. District Courts.
