# §29.902. Does the Equal Access to Justice Act apply to the Program?


The Equal Access to Justice Act (EAJA), 5 U.S.C. [504](/usc/5/504.md) and [28](/usc/5/28.md) U.S.C. 2414, and the relevant implementing regulations (48 CFR [6101.30](/cfr/48/6101.30.md) and [6101.31](/cfr/48/6101.31.md); [49 CFR part 6](/cfr/49/part6.md)) will apply if the Tribe's compact or funding agreement make these provisions applicable.
