# §29.421. May a Tribe redesign, consolidate, reallocate, or redirect the funds included in a funding agreement?

- (a) A Tribe may redesign, consolidate, reallocate, or redirect funds included in a funding agreement in any manner it considers to be in the best interest of the Indian community being served, provided that:
  - (1) The funds are expended on projects identified in a transportation improvement program approved by the Department, where statutorily required; and
  - (2) The funds are used in accordance with the requirements in appropriations acts, [title 23](/cfr/23.md) of the U.S. Code, chapter 53 of title 49 of the U.S. Code, and any other applicable law.
- (b) Consistent with [23 U.S.C. 207(e)(1)(B)](/usc/23/207.md?p=e-1-B), a Tribe may not redesign, consolidate, reallocate, or redirect any discretionary or competitive grant funds or State transfers of funds that are included in the funding agreement. A Tribe may use remaining funds from a discretionary or competitive grant in accordance with [§ 29.410](/cfr/49/29.410.md).
