# §236.1001. Purpose and scope.

- (a) This subpart prescribes minimum, performance-based safety standards for PTC systems required by [49 U.S.C. 20157](/usc/49/20157.md), this subpart, or an FRA order, including requirements to ensure that the development, functionality, architecture, installation, implementation, inspection, testing, operation, maintenance, repair, and modification of those PTC systems will achieve and maintain an acceptable level of safety. This subpart also prescribes standards to ensure that personnel working with, and affected by, safety-critical PTC system related products receive appropriate training and testing.
- (b) Each railroad may prescribe additional or more stringent rules, and other special instructions, that are not inconsistent with this subpart.
- (c) This subpart does not exempt a railroad from compliance with any requirement of subparts [A](/cfr/49/subpartA.md) through [H](/cfr/49/subpartH.md) of this part or parts [233](/cfr/49/part233.md), [234](/cfr/49/part234.md), and 235 of this chapter, unless:
  - (1) It is otherwise explicitly excepted by this subpart; or
  - (2) The applicable PTCSP, as defined under [§ 236.1003](/cfr/49/236.1003.md) and approved by FRA under [§ 236.1015](/cfr/49/236.1015.md), provides for such an exception per [§ 236.1013](/cfr/49/236.1013.md).
