# §23.81. ACDBE reevaluation process.

- (a) **Effective October 3, 2025, each UCP must—**
  - (1) Identify each currently certified ACDBE;
  - (2) Provide each firm identified pursuant to [paragraph (a)(1)](#a-1) of this section with the opportunity to submit documentation demonstrating its ACDBE eligibility under the standards set forth in this part;
  - (3) Determine whether each firm identified pursuant to [paragraph (a)(1)](#a-1) of this section meets the ACDBE eligibility standards set forth in this part; and
  - (4) Issue a written decision to each firm reevaluated pursuant to [subparagraph (a)(3)](#a-3), indicating that it has either been recertified or is decertified.
- (b) The provisions of [§ 26.87](/cfr/49/26.87.md) of this chapter shall not apply to any action taken pursuant to [paragraph (a)](#a) of this section.
- (c) Each UCP must reevaluate each firm identified pursuant to [paragraph (a)(1)](#a-1) of this section as quickly as practicable and must promptly notify the Department when it has done so. The Department reserves the right to review a UCP's reevaluation process.
