# §218.41. Noncompliance with hump operations rule.


A person (including a railroad and any manager, supervisor, official, or other employee or agent of a railroad) who fails to comply with a railroad's operating rule issued pursuant to [§ 218.39](/cfr/49/218.39.md) is subject to a penalty. See FRA's website at https://railroads.dot.gov/ for a statement of agency civil penalty policy.
