# §209.335. Penalties.

- (a) Any individual who violates [§ 209.331(c)](/cfr/49/209.331.md?p=c) or [§ 209.333(a)](/cfr/49/209.333.md?p=a) may be permanently disqualified from performing the safety-sensitive functions described in [§ 209.303](/cfr/49/209.303.md). Any individual who willfully violates [§ 209.331(c)](/cfr/49/209.331.md?p=c) or [§ 209.333(a)](/cfr/49/209.333.md?p=a) may also be assessed a civil penalty of at least the minimum civil monetary penalty and not more than the ordinary maximum civil monetary penalty per violation. See [49 CFR part 209](/cfr/49/part209.md), appendix A.
- (b) Any railroad that violates § [209.331(a)](/cfr/49/209.331.md?p=a) or [(b)](/cfr/49/209.331.md?p=b) or [§ 209.333(b)](/cfr/49/209.333.md?p=b) may be assessed a civil penalty of at least the minimum civil monetary penalty and not more than the ordinary maximum civil monetary penalty per violation. See [49 CFR part 209](/cfr/49/part209.md), appendix A.
- (c) Each day a violation continues shall constitute a separate offense.
