# §10.85. Wrongfully obtaining records.


Any person who knowingly and willfully requests or obtains any record concerning an individual from the Department under false pretenses is guilty of a misdemeanor and fined not more than $5,000 in accordance with [5 U.S.C. 552a(i)(3)](/usc/5/552a.md?p=i-3).
