# §32.401. Statutory authority.


The agency may authorize advance payments in negotiated and sealed bid contracts if the action is appropriate under

- (a) 41 U.S.C. chapter 45;
- (b) 10 U.S.C. chapter 277; or
- (c) **Pub.** L. 85-804 ([50 U.S.C. 1431-1435](/usc/50/1431-1435.md)) and Executive Order 10789, November 14, 1958 ([3 CFR 1958](/cfr/3/1958.md) Supp. pp. 72-74) (see [Subpart 50.1](/cfr/48/subpart50.1.md) for other applications of this statute).
