# §72.05-1. Application.

- (a) **The provisions of this subpart apply to the following vessels—**
  - (1) **All vessels of 100 gross tons or more.**
  - (2) **All vessels with overnight accommodations for more than 150 passengers.**
  - (3) **All vessels on an international voyage.**
- (b) The provisions of this subpart, with the exception of [§ 72.05-90](/cfr/46/72.05-90.md), apply to all vessels noted in [paragraph (a)](#a) of this section contracted for on or after May 26, 1965. Such vessels contracted for prior to May 26, 1965, must meet the requirements of [§ 72.05-90](/cfr/46/72.05-90.md).
- (c) Vessels meeting the structural fire protection requirements of SOLAS, [Chapter II-2](/cfr/46/chII..2.md), Regulations 5, 6, 8, 9, and 11 (incorporated by reference, see [§ 72.01-2](/cfr/46/72.01-2.md)), when combined with the stair requirements in [§ 72.05-20](/cfr/46/72.05-20.md) may be considered equivalent to the provisions of this subpart.
- (d) Vessels regulated under subchapter K of this chapter which carry more than 600 passengers or with overnight accommodations for more than 49 passengers must also meet the requirements for stairways, ladders and elevators in [§ 72.05-20](/cfr/46/72.05-20.md) (see [46 CFR 116.438(a)](/cfr/46/116.438.md?p=a)).
