# §532.2. Scope and applicability.


This part exempts NVOCCs duly licensed pursuant to [46 CFR 515.3](/cfr/46/515.3.md) or registered pursuant to [46 CFR 515.19](/cfr/46/515.19.md), holding adequate proof of financial responsibility pursuant to [46 CFR 515.21](/cfr/46/515.21.md), and meeting the requirements of [46 CFR 532.4 through 532.7](/cfr/46/532.4..532.7.md), from the following requirements and prohibitions of the Shipping Act and the Commission's regulations:

- (a) The requirement in [46 U.S.C. 40501(a)-(c)](/usc/46/40501.md?p=a..c) that the NVOCC include its rates in a tariff open to public inspection in an automated tariff system;
- (b) [46 U.S.C. 40501(d)](/usc/46/40501.md?p=d);
- (c) [46 U.S.C. 40501(e)](/usc/46/40501.md?p=e)
- (d) [46 U.S.C. 40503](/usc/46/40503.md);
- (e) The prohibition in [46 U.S.C. 41104(a)(2)(A)](/usc/46/41104.md?p=a-2-A);
- (f) the Commission's corresponding regulation at [46 CFR 520.3(a)](/cfr/46/520.3.md?p=a) that the NVOCC include its rates in a tariff open for public inspection in an automated tariff system; and
- (g) the Commission's corresponding regulations at 46 CFR [520.4(a)(4)](/cfr/46/520.4.md?p=a-4), [520.4(f)](/cfr/46/520.4.md?p=f), [520.6(e)](/cfr/46/520.6.md?p=e), [520.7(c)](/cfr/46/520.7.md?p=c), [(d)](/cfr/46/520.7.md?p=d), [520.8(a)](/cfr/46/520.8.md?p=a), [520.12](/cfr/46/520.12.md), and [520.14](/cfr/46/520.14.md). Any NVOCC failing to maintain its bond or license or registration as set forth above, or who has had its tariff suspended by the Commission, shall not be eligible to invoke this exemption.
