# §116.400. Application.

- (a) This subpart applies to:
  - (1) Vessels carrying more than 150 passengers; or
  - (2) **Vessels with overnight accommodations for more than 49 passengers but not more than 150 passengers.**
- (b) A vessel with overnight accommodations for more than 150 passengers must comply with [§ 72.05](/cfr/46/72.05.md) in subchapter H of this chapter.
- (c) Vessels meeting the structural fire protection requirements of SOLAS, [Chapter II-2](/cfr/46/chII..2.md), Regulations 5, 6, 8, 9, and 11 (incorporated by reference, see [§ 114.600](/cfr/46/114.600.md) of this chapter), when combined with the requirements in [§ 116.438](/cfr/46/116.438.md), may be considered equivalent to the provisions of this subpart.
