# §86.15. Admissions.

- (a) **Admissions to educational institutions prior to June 24, 1973, are not covered by this part.**
- (b) **Administratively separate units.** For the purposes only of this section, §§ [86.16](/cfr/45/86.16.md) and [86.17](/cfr/45/86.17.md), and [subpart C](/cfr/45/subpartC.md), each administratively separate unit shall be deemed to be an educational institution.
- (c) **Application of subpart C.** Except as provided in paragraphs [(d)](#d) and [(e)](#e) of this section, [subpart C](/cfr/45/subpartC.md) applies to each recipient. A recipient to which [subpart C](/cfr/45/subpartC.md) applies shall not discriminate on the basis of sex in admission or recruitment in violation of that subpart.
- (d) **Educational institutions.** Except as provided in [paragraph (e)](#e) of this section as to recipients which are educational institutions, [Subpart C](/cfr/45/subpartC.md) applies only to institutions of vocational education, professional education, graduate higher education, and public institutions of undergraduate higher education.
- (e) **Public institutions of undergraduate higher education.** Subpart C does not apply to any public institution of undergraduate higher education which traditionally and continually from its establishment has had a policy of admitting only students of one sex.
