# §263.9. May a State avoid a penalty for failing to meet the basic MOE requirement through reasonable cause or corrective compliance?


No. The reasonable cause and corrective compliance provisions at §§ [262.4](/cfr/45/262.4.md), [262.5](/cfr/45/262.5.md), and [262.6](/cfr/45/262.6.md) of this chapter do not apply to the penalties in [§ 263.8](/cfr/45/263.8.md).
