# §262.2. When do the TANF penalty provisions apply?

- (a) A State will be subject to the penalties specified in § [262.1(a)(1)](/cfr/45/262.1.md?p=a-1), [(2)](/cfr/45/262.1.md?p=a-2), [(7)](/cfr/45/262.1.md?p=a-7), [(8)](/cfr/45/262.1.md?p=a-8), [(9)](/cfr/45/262.1.md?p=a-9), [(10)](/cfr/45/262.1.md?p=a-10), [(11)](/cfr/45/262.1.md?p=a-11), [(12)](/cfr/45/262.1.md?p=a-12), [(13)](/cfr/45/262.1.md?p=a-13), and [(14)](/cfr/45/262.1.md?p=a-14) for conduct occurring on and after the first day the State operates the TANF program.
- (b) A State will be subject to the penalties specified in § [262.1(a)(3)](/cfr/45/262.1.md?p=a-3), [(4)](/cfr/45/262.1.md?p=a-4), [(5)](/cfr/45/262.1.md?p=a-5), and [(6)](/cfr/45/262.1.md?p=a-6) for conduct occurring on and after July 1, 1997, or the date that is six months after the first day the State operates the TANF program, whichever is later.
- (c) For the time period prior to October 1, 1999, we will assess State conduct as specified in [§ 260.40(b)](/cfr/45/260.40.md?p=b) of this chapter.
- (d) The penalty specified in [§ 262.1(a)(15)](/cfr/45/262.1.md?p=a-15) takes effect on October 1, 2006, for failure to establish work participation verification procedures and on October 1, 2007, for failure to comply with those procedures.
- (e) In accordance with § [264.61(a)](/cfr/45/264.61.md?p=a) and [(b)](/cfr/45/264.61.md?p=b) of this chapter, the penalty specified in [§ 262.1(a)(16)](/cfr/45/262.1.md?p=a-16) will be imposed for FY 2014 and each succeeding fiscal year.
