# §1325.4. Rights of individuals with developmental disabilities.

- (a) Section 109 of the Act, Rights of Individuals with Developmental Disabilities ([42 U.S.C. 15009](/usc/42/15009.md)), is applicable to the SCDD.
- (b) In order to comply with section 124(c)(5)(H) of the Act ([42 U.S.C. 15024(c)(5)(H)](/usc/42/15024.md?p=c-5-H)), regarding the rights of individuals with developmental disabilities, the State participating in the SCDD program must meet the requirements of [45 CFR 1326.30(f)](/cfr/45/1326.30.md?p=f).
- (c) Applications from UCEDDs also must contain an assurance that the human rights of individuals assisted by this program will be protected consistent with [section 101(c)](/cfr/45/101.md?p=c) (see section 154(a)(3)(D) of the Act).
