# §1304.17. Flexibility for Head Start Designation Renewal Determinations in Certain Emergencies.

- (a) In reviewing the relevant data as described in [§ 1304.15(b)](/cfr/45/1304.15.md?p=b), if ACF determines that one or more data elements described in the conditions in section [§ 1304.11](/cfr/45/1304.11.md) is not available due to an emergency described in [paragraph (b)](#b) of this section, ACF may make a designation renewal determination based on the data elements that are available.
- (b) **The emergencies are—**
  - (1) **A major disaster declared by the President under section 401 of the Robert T.** Stafford Disaster Relief and Emergency Assistance Act ([42 U.S.C. 5170](/usc/42/5170.md)).
  - (2) **An emergency declared by the President under section 501 of the Robert T.** Stafford Disaster Relief and Emergency Assistance Act ([42 U.S.C. 5191](/usc/42/5191.md)).
  - (3) A public health emergency declared by the Secretary pursuant to section 319 of the Public Health Service Act ([42 U.S.C. 247d](/usc/42/247d.md)).
