# §7.6. Life, health, and safety.


Notwithstanding the provisions of [section 5](/cfr/44/5.md), a recipient of Federal financial assistance shall not be deemed to have failed to comply with [section 3](/cfr/44/3.md), if immediate provision of a service or other benefit to an individual is necessary to prevent his death or serious impairment of his health or safety.
