# §4170.2-2. Penal provisions under the Federal Land Policy and Management Act.


Under [section 303(a)](/cfr/43/303.md?p=a) of the Federal Land Policy and Management Act of 1976 ([43 U.S.C. 1701](/usc/43/1701.md) et seq.), any person who knowingly and willfully commits an act prohibited under [§ 4140.1(b)](/cfr/43/4140.1.md?p=b) or who knowingly and willfully violates approved special rules and regulations may be brought before a designated U.S. magistrate and is punishable by a fine in accordance with the applicable provisions of [Title 18](/cfr/18.md) of the United States Code, or imprisonment for no more than 12 months, or both.
