# §3936.40. Appeals.


Notices of noncompliance and orders or decisions issued under the regulations in this part may be appealed as provided in [part 4 of this title](/cfr/43/part4.md). All decisions and orders by the BLM under this part remain effective pending appeal unless the BLM decides otherwise. A petition for the stay of a decision may be filed with the IBLA.
