# §3461.0-3. Authority.

- (a) These regulations are issued under the authority of the statutes listed in [§ 3400.0-3](/cfr/43/3400.0-3.md) of this title.
- (b) **These regulations primarily implement—**
  - (1) The general unsuitability criteria in [section 522(a)](/cfr/43/522.md?p=a) of the Surface Mining Control and Reclamation Act of 1977 ([30 U.S.C. 1272(a)](/usc/30/1272.md?p=a));
  - (2) The Federal lands review in [section 522(b)](/cfr/43/522.md?p=b) of the Surface Mining Control and Reclamation Act of 1977 ([30 U.S.C. 1272(b)](/usc/30/1272.md?p=b)); and
  - (3) The prohibitions against mining certain lands in [section 522(e)](/cfr/43/522.md?p=e) of the Surface Mining Control and Reclamation Act of 1977 ([30 U.S.C. 1272(e)](/usc/30/1272.md?p=e)).

Authority: The Mineral Leasing Act of 1920, as amended and supplemented (30 U.S.C. 181 et seq. ), the Mineral Leasing Act for Acquired Lands of 1947, as amended (30 U.S.C. 351-359), the Multiple Mineral Development Act of 1954 (30 U.S.C. 521-531 et seq. ), the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1201 et seq. ) and the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1701 et seq. ).
