# §17.312. Burden of proof.


The burden of proving that an age distinction or other action falls within the exceptions outlined in §§ [17.311(b)](/cfr/43/17.311.md?p=b) and [17.311(c)](/cfr/43/17.311.md?p=c), is on the recipient of Federal financial assistance.
