# §62.11. When can a scholarship program payment obligation be discharged in bankruptcy?


In accordance with section 754(d)(3) of the Act, any payment obligation incurred under [§ 62.10](/cfr/42/62.10.md) may not be discharged in bankruptcy under title XI of the United States Code until 5 years after the date on which the payment obligation is due.
