# §460.56. Procedures for imposing sanctions and civil money penalties.


CMS provides notice and a right to request a hearing according to the procedures set forth in either of the following:

- (a) Section [422.756(a)](/cfr/42/422.756.md?p=a) and [(b)](/cfr/42/422.756.md?p=b) of this chapter if CMS imposes a suspension of enrollment or payment under [§ 460.42](/cfr/42/460.42.md) or [§ 460.48(b)](/cfr/42/460.48.md?p=b).
- (b) [Section 422.756(e)(2)(v)](/cfr/42/422.756.md?p=e-2-v) of this chapter if CMS imposes civil money penalties under [§ 460.46](/cfr/42/460.46.md).
