# §428.400. Definitions.


For the purposes of this subpart, date of receipt is the calendar day following the day in which a report of a rebate amount (as set forth in §§ [428.401(b)](/cfr/42/428.401.md?p=b), [(c)](/cfr/42/428.401.md?p=c), and [(d)](/cfr/42/428.401.md?p=d) and [428.402(b)](/cfr/42/428.402.md?p=b) and [(c)](/cfr/42/428.402.md?p=c)) is made available to the manufacturer of a Part D rebatable drug by CMS.
