# §423.880. Basis and scope.

- (a) **Basis.** This subpart is based on section 1860D-22 of the Act, as amended by [section 101](/cfr/42/101.md) of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (MMA).
- (b) **Scope.** This section implements the statutory requirement that a subsidy payment be made to sponsors of qualified retiree prescription drug plans.
