# §3.418. Exclusivity of penalty.

- (a) Except as otherwise provided by [paragraph (b)](#b) of this section, a penalty imposed under this part is in addition to any other penalty prescribed by law.
- (b) Civil money penalties shall not be imposed both under this part and under the HIPAA Privacy Rule (45 CFR parts [160](/cfr/45/part160.md) and [164](/cfr/45/part164.md)).
