# §3.404. Amount of a civil money penalty.

- (a) The amount of a civil money penalty will be determined in accordance with [paragraph (b)](#b) of this section and [§ 3.408](/cfr/42/3.408.md).
- (b) The Secretary may impose a civil monetary penalty in the amount of not more than $11,000. This amount has been updated and will be updated annually, in accordance with the Federal Civil Monetary penalty Inflation Adjustment Act of 1990 (Pub. L. 101-140), as amended by the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 ([section 701](/cfr/42/701.md) of Pub. L. 114-74). The amount, as updated, is published at [45 CFR part 102](/cfr/45/part102.md).
