# §1002.6. Payment prohibitions.

- (a) **Denial of payment by State agencies.** Except as provided for in § [1001.1901(c)(3)](/cfr/42/1001.1901.md?p=c-3), [(4)](/cfr/42/1001.1901.md?p=c-4) and [(5)(i)](/cfr/42/1001.1901.md?p=5-i) of this chapter, no payment may be made by the State agency for any item or service furnished on or after the effective date specified in the notice:
  - (1) By an individual or entity excluded by the OIG or
  - (2) At the medical direction or on the prescription of a physician or other authorized individual who is excluded by the OIG when a person furnishing such item or service knew, or had reason to know, of the exclusion.
- (b) **Denial of Federal financial participation (FFP).** FFP is not available for any item or service for which the State agency is required to deny payment under [paragraph (a)](#a) of this section. FFP will be available for items and services furnished after the excluded individual or entity is reinstated in the Medicaid program.
