# §102-37.340. Donee certifications.


Prior to a SASP releasing property to a donee, the donee must certify that:

- (a) It is a public agency or a nonprofit organization meeting the requirements of the Property Act and/or regulations of GSA;
- (b) It is acquiring the property for its own use and will use the property for authorized purposes;
- (c) Funds are available to pay all costs and charges incident to the donation;
- (d) It will comply with the nondiscrimination regulations issued under title VI of the Civil Rights Act of 1964 ([42 U.S.C. 2000d-2000d-4](/usc/42/2000d-2000d-4.md)), [40 U.S.C. 122](/usc/40/122.md), section 504 of the Rehabilitation Act of 1973 ([29 U.S.C. 794](/usc/29/794.md)), as amended, title IX of the Education Amendments of 1972 ([20 U.S.C. 1681-1688](/usc/20/1681-1688.md)), as amended, and section 303 of the Age Discrimination Act of 1975 ([42 U.S.C. 6101-6107](/usc/42/6101-6107.md)); and
- (e) It is not currently debarred, suspended, declared ineligible, or otherwise excluded from receiving the property.
