# §770.5. Prohibited acts.

- (a) Failure or refusal to comply with any requirement of TSCA [section 601](/cfr/40/601.md) ([15 U.S.C. 2697](/usc/15/2697.md)) or this part is a violation of TSCA [section 15](/cfr/40/15.md) ([15 U.S.C. 2614](/usc/15/2614.md)).
- (b) Failure or refusal to establish and maintain records or to make available or permit access to or copying of records, as required by this part, is a violation of TSCA [section 15](/cfr/40/15.md) ([15 U.S.C. 2614](/usc/15/2614.md)).
- (c) Making false or misleading statements in any statement, certification, or record required by this part is a violation of TSCA [section 15](/cfr/40/15.md) ([15 U.S.C. 2614](/usc/15/2614.md)).
- (d) Violators may be subject to civil and criminal sanctions pursuant to TSCA [section 16](/cfr/40/16.md) ([15 U.S.C. 2615](/usc/15/2615.md)) for each violation.
