# §766.5. Compliance.


Any person who fails or refuses to comply with any aspect of this part is in violation of [section 15](/cfr/40/15.md) of TSCA. [Section 15(1)](/cfr/40/15.md?p=1) makes it unlawful for any person to fail or refuse to comply with any rule or order issued under [section 4](/cfr/40/4.md). [Section 15(3)](/cfr/40/15.md?p=3) makes it unlawful for any person to fail or refuse to submit information required under this part. [Section 16](/cfr/40/16.md) provides that a violation of [section 15](/cfr/40/15.md) renders a person liable to the United States for a civil penalty and possible criminal prosecution. Under [section 17](/cfr/40/17.md) of TSCA, the district courts of the United States have jurisdiction to restrain any violation of [section 15](/cfr/40/15.md).
