# §721.9850. 2,4,8,10-Tetraoxa-3,9-diphosphaspiro[5.5]undecane, 3,9-bis[2,4,6-tris(1,1-dimethylethyl)phenoxy]-.

- (a) **Chemical substance and significant new uses subject to reporting.**
  - (1) The chemical substance identified as 2,4,8,10-tetraoxa-3,9-diphosphaspiro[5.5]undecane, 3,9-bis[2,4,6-tris(1,1-dimethylethyl)phenoxy]- (PMN P-91-65; CAS number 126505-35-9) is subject to reporting under this section for the significant new uses described in [paragraph (a)(2)](#a-2) of this section.
  - (2) **The significant new uses are—**
    - (i) **Protection in the workplace.** Requirements as specified in § [721.63 (a)(1)](/cfr/40/721.63.md?p=a-1), [(a)(3)](/cfr/40/721.63.md?p=a-3), [(a)(4)](/cfr/40/721.63.md?p=a-4), [(a)(5)(ii)](/cfr/40/721.63.md?p=a-5-ii), [(a)(5)(iv)](/cfr/40/721.63.md?p=a-5-iv), [(a)(5)(v)](/cfr/40/721.63.md?p=a-5-v), [(a)(6)(i)](/cfr/40/721.63.md?p=a-6-i), [(b)](/cfr/40/721.63.md?p=a-6-b) (concentration set at 1.0 percent), and (c).
    - (ii) **Hazard communication program.** Requirements as specified in § [721.72 (a)](/cfr/40/721.72.md?p=a), [(b)](/cfr/40/721.72.md?p=b), [(c)](/cfr/40/721.72.md?p=c), [(d)](/cfr/40/721.72.md?p=d), [(e)](/cfr/40/721.72.md?p=e) (concentration set at 1.0 percent), (f), (g)(1)(iii), (g)(1)(vi), (g)(1)(ix), (g)(2)(i) through (v), and (g)(5).
    - (iii) **Industrial, commercial, and consumer activities.** Requirements as specified in [§ 721.80(q)](/cfr/40/721.80.md?p=q).
- (b) **Specific requirements.** The provisions of subpart A of this part apply to this section except as modified by this paragraph.
  - (1) **Recordkeeping requirements.** Requirements as specified in [§ 721.125 (a) through (h)](/cfr/40/721.125.md?p=a..h) are applicable to manufacturers, importers, and processors of this substance.
  - (2) **Limitations or revocation of certain notification requirements.** The provisions of [§ 721.185](/cfr/40/721.185.md) apply to this section.
  - (3) **Determining whether a specific use is subject to this section.** The provisions of [§ 721.1725(b)(1)](/cfr/40/721.1725.md?p=b-1) apply to this section.
