# §721.5325. Nickel, tris(neodecanoato-.kappa.O)[.mu.3-[orthoborato(3-)-.kappa.O:.kappa.O′:.kappa.O″]]tri-.

- (a) **Chemical substance and significant new uses subject to reporting.**
  - (1) The chemical substance identified as nickel, tris(neodecanoato-.kappa.O)[.mu.3-[orthoborato(3-)-.kappa.O:.kappa.O′:.kappa.O″]]tri- (PMN P-85-1034; CAS No. 936576-64-6) is subject to reporting under this section for the significant new uses described in [paragraph (a)(2)](#a-2) of this section.
  - (2) **The significant new uses are—**
    - (i) **Protection in the workplace.** Requirements as specified in § [721.63 (a)(1)](/cfr/40/721.63.md?p=a-1), [(a)(3)](/cfr/40/721.63.md?p=a-3), [(b)](/cfr/40/721.63.md?p=a-b) (concentration set at 0.1 percent), and (c).
    - (ii) **Hazard communication program.** Requirements as specified in § [721.72 (b)(2)](/cfr/40/721.72.md?p=b-2), [(c)](/cfr/40/721.72.md?p=b-c), [(d)](/cfr/40/721.72.md?p=b-d), [(e)](/cfr/40/721.72.md?p=b-e) (concentration set at 0.1 percent), (f), (g)(1)(iv), (g)(1)(vii), (g)(2)(i) through (g)(2)(iii), (g)(2)(v), (g)(4)(i), and (g)(5). The provision of [§ 721.72(d)](/cfr/40/721.72.md?p=d) requiring that employees to be provided with information on the location and availability of a written hazard communication program does not apply when the written program is not required under [§ 721.72(a)](/cfr/40/721.72.md?p=a).
    - (iii) **Industrial, commercial, and consumer activities.** Requirements as specified in [§ 721.80(k)](/cfr/40/721.80.md?p=k).
    - (iv) **Disposal.** Requirements as specified in § [721.85 (a)(1)](/cfr/40/721.85.md?p=a-1), [(a)(2)](/cfr/40/721.85.md?p=a-2), [(b)(1)](/cfr/40/721.85.md?p=b-1), [(b)(2)](/cfr/40/721.85.md?p=b-2), [(c)(1)](/cfr/40/721.85.md?p=c-1), and [(c)(2)](/cfr/40/721.85.md?p=c-2).
- (b) **Specific requirements.** The provisions of subpart A of this part apply to this section except as modified by this paragraph.
  - (1) **Recordkeeping.** The following recordkeeping requirements are applicable to manufacturers, importers, and processors of this substance, as specified in § [721.125 (a)](/cfr/40/721.125.md?p=a), [(b)](/cfr/40/721.125.md?p=b), [(c)](/cfr/40/721.125.md?p=c), [(e)](/cfr/40/721.125.md?p=e), [(f)](/cfr/40/721.125.md?p=f), [(g)](/cfr/40/721.125.md?p=g), and [(h)](/cfr/40/721.125.md?p=h).
  - (2) **Limitations or revocation of certain notification requirements.** The provisions of [§ 721.185](/cfr/40/721.185.md) apply to this significant new use rule.
  - (3) **Determining whether a specific use is subject to this section.** The provisions of [§ 721.1725(b)(1)](/cfr/40/721.1725.md?p=b-1) apply to this section.
