# §721.3440. Haloalkyl substituted cyclic ethers.

- (a) **Chemical substance and significant new uses subject to reporting.**
  - (1) The chemical substances haloalkyl substituted cyclic ethers (PMN P-85-368 and P-85-369) are subject to reporting under this section for the significant new uses described in this paragraph.
    - (i) **The significant new uses are—**
      - (A) **Protection in the workplace.** Requirements as specified in § [721.63 (a)(1)](/cfr/40/721.63.md?p=a-1), [(a)(3)](/cfr/40/721.63.md?p=a-3), [(a)(4)](/cfr/40/721.63.md?p=a-4), [(a)(5)(i)](/cfr/40/721.63.md?p=a-5-i), [(a)(5)(ii)](/cfr/40/721.63.md?p=a-5-ii), [(a)(5)(iii)](/cfr/40/721.63.md?p=a-5-iii) and [(a)(6)(v)](/cfr/40/721.63.md?p=a-6-v) and [(a)(6)(vi)](/cfr/40/721.63.md?p=a-6-vi), [(b)](/cfr/40/721.63.md?p=a-6-b) [concentration set at 1.0 percent], and (c).
      - (B) **Hazard communication program.** Requirements as specified in § [721.72 (a)](/cfr/40/721.72.md?p=a), [(d)](/cfr/40/721.72.md?p=d), [(e)](/cfr/40/721.72.md?p=e) [concentration set at 1.0 percent], (f), and (g)(1)(iii), (g)(2)(i), (g)(2)(ii), (g)(2)(iv) and (g)(2)(v), and (g)(5). The provision of [§ 721.72(d)](/cfr/40/721.72.md?p=d) requiring that employees be provided with information on the location and availability of SDSs does not apply when a SDS was not required under [§ 721.72(c)](/cfr/40/721.72.md?p=c). The provisions of [§ 721.72(g)](/cfr/40/721.72.md?p=g) requiring placement of specific information on a label and SDS do not apply when a label and SDS are not required under § [721.72 (b)](/cfr/40/721.72.md?p=b) and [(c)](/cfr/40/721.72.md?p=c), respectively.
      - (C) **Industrial, commercial, and consumer activities.** Requirements as specified in [§ 721.80(k)](/cfr/40/721.80.md?p=k).
      - (D) **Disposal.** Requirements as specified in § [721.85 (a)(1)](/cfr/40/721.85.md?p=a-1) and [(a)(2)](/cfr/40/721.85.md?p=a-2), [(b)(1)](/cfr/40/721.85.md?p=b-1) and [(b)(2)](/cfr/40/721.85.md?p=b-2), and [(c)(1)](/cfr/40/721.85.md?p=c-1) and [(c)(2)](/cfr/40/721.85.md?p=c-2).
    - (ii) **Specific requirements.** The provisions of subpart A of this part apply to this section except as modified by this paragraph.
      - (A) **Recordkeeping.** The following recordkeeping requirements are applicable to manufacturers, importers, and processors of the substances, as specified in [§ 721.125 (a) through (k)](/cfr/40/721.125.md?p=a..k).
      - (B) **Limitations or revocation of certain notification requirements.** The provisions of [§ 721.185](/cfr/40/721.185.md) apply to this significant new use rule.
      - (C) **Determining whether a specific use is subject to this section.** The provisions of [§ 721.1725(b)(1)](/cfr/40/721.1725.md?p=b-1) apply to this section.
  - (2) The chemical substance haloalkyl substituted cyclic ether (PMN P-85-367) is subject to reporting under this section for the significant new uses described in this paragraph.
    - (i) **The significant new uses are—**
      - (A) **Protection in the workplace.** Requirements as specified in § [721.63 (a)(1)](/cfr/40/721.63.md?p=a-1), [(a)(3)](/cfr/40/721.63.md?p=a-3), [(a)(4)](/cfr/40/721.63.md?p=a-4), [(a)(5)(i)](/cfr/40/721.63.md?p=a-5-i), [(a)(5)(ii)](/cfr/40/721.63.md?p=a-5-ii), [(a)(5)(iii)](/cfr/40/721.63.md?p=a-5-iii), and [(a)(6)(v)](/cfr/40/721.63.md?p=a-6-v) and [(a)(6)(vi)](/cfr/40/721.63.md?p=a-6-vi), [(b)](/cfr/40/721.63.md?p=a-6-b) [concentration set at 0.1 percent], and (c).
      - (B) **Hazard communication program.** Requirements as specified in § [721.72 (a)](/cfr/40/721.72.md?p=a), [(d)](/cfr/40/721.72.md?p=d), [(e)](/cfr/40/721.72.md?p=e) [concentration set at 0.1 percent], (f), and (g)(1)(iii), (g)(1)(vii), (g)(2)(i), (g)(2)(ii), (g)(2)(iv) and (g)(2)(v), and (g)(5). The provision of [§ 721.72(d)](/cfr/40/721.72.md?p=d) requiring that employees be provided with information on the location and availability of SDSs does not apply when a SDS was not required under [§ 721.72(c)](/cfr/40/721.72.md?p=c).
