# §721.11348. Substituted aryl perfluoropolyether (generic).

- (a) **Chemical substance and significant new uses subject to reporting.**
  - (1) The chemical substance identified generically as substituted aryl perfluoropolyether (PMN P-16-153) is subject to reporting under this section for the significant new uses described in [paragraph (a)(2)](#a-2) of this section.
  - (2) **The significant new uses are—**
    - (i) **Hazard communication.** Requirements as specified in § [721.72(a) through (f)](/cfr/40/721.72.md?p=a..f), [(g)(3)(i)](/cfr/40/721.72.md?p=g-3-i) and [(ii)](/cfr/40/721.72.md?p=g-3-ii), [(g)(4)(i)](/cfr/40/721.72.md?p=g-4-i) and [(iii)](/cfr/40/721.72.md?p=g-4-iii), and [(g)(5)](/cfr/40/721.72.md?p=g-g-5). Alternative hazard and warning statements that meet the criteria of the Globally Harmonized System and OSHA Hazard Communication Standard may be used. For purposes of [§ 721.72(e)](/cfr/40/721.72.md?p=e), the concentration is set at 1.0%.
    - (ii) **Industrial, commercial, and consumer activities.** Requirements as specified in § [721.80(k)](/cfr/40/721.80.md?p=k) and [(t)](/cfr/40/721.80.md?p=t).
    - (iii) **Disposal.** Requirements as specified in § [721.85(a)(1)](/cfr/40/721.85.md?p=a-1), [(b)(1)](/cfr/40/721.85.md?p=b-1), and [(c)(1)](/cfr/40/721.85.md?p=c-1). Incineration must be hazardous waste high temperature incineration where the treatment efficiency is no less than 99.99%.
    - (iv) **Release to water.** Requirements as specified in § [721.90(a)(1)](/cfr/40/721.90.md?p=a-1), [(b)(1)](/cfr/40/721.90.md?p=b-1), and [(c)(1)](/cfr/40/721.90.md?p=c-1).
- (b) **Specific requirements.** The provisions of subpart A of this part apply to this section except as modified by this paragraph.
  - (1) **Recordkeeping.** Recordkeeping requirements as specified in § [721.125(a) through (c)](/cfr/40/721.125.md?p=a..c) and [(f) through (k)](/cfr/40/721.125.md?p=f..k) are applicable to manufacturers and processors of this substance.
  - (2) **Limitation or revocation of certain notification requirements.** The provisions of [§ 721.185](/cfr/40/721.185.md) apply to this section.
  - (3) **Determining whether a specific use is subject to this section.** The provisions of [§ 721.1725(b)(1)](/cfr/40/721.1725.md?p=b-1) apply to [paragraph (a)(2)(ii)](#a-2-ii) of this section.
