# §721.11202. Amine- and hydroxy-functional acrylic polymer (generic).

- (a) **Chemical substance and significant new uses subject to reporting.**
  - (1) The chemical substance identified generically as amine- and hydroxy-functional acrylic polymer (PMN P-17-380) is subject to reporting under this section for the significant new uses described in [paragraph (a)(2)](#a-2) of this section. The requirements of this section do not apply to quantities of the substance after they have been completely entrained in dried coating.
  - (2) **The significant new uses are—**
    - (i) **Hazard communication.** Requirements as specified in [§ 721.72(a) through (e)](/cfr/40/721.72.md?p=a..e) (concentration set at 1.0%), (f), (g)(1)(ii), (g)(2)(ii), (g)(3)(ii), (g)(4)(i), and (g)(5). Alternative hazard and warning statements that meet the criteria of the Globally Harmonized System and OSHA Hazard Communication Standard may be used. For purposes of [§ 721.63(g)(4)(i)](/cfr/40/721.63.md?p=g-4-i), do not release to water without pre-treatment of water releases at an onsite waste water treatment plant with at least 96% efficiency.
    - (ii) **Industrial, commercial, and consumer activities.** Requirements as specified in [§ 721.80(k)](/cfr/40/721.80.md?p=k). It is a significant new use to use the substance without the confidential engineering controls specified in the TSCA [section 5(e)](/cfr/40/5.md?p=e) Order. It is a significant new use to manufacture or use the substance with methods that generate a dust, spray, mist, or aerosol.
    - (iii) **Disposal.** Requirements as specified in § [721.85(a)(1)](/cfr/40/721.85.md?p=a-1), [(b)(1)](/cfr/40/721.85.md?p=b-1), and [(c)(1)](/cfr/40/721.85.md?p=c-1).
    - (iv) **Release to water.** It is a significant new use to release to water without pretreatment at an on-site wastewater treatment plant with at least 96% efficiency.
- (b) **Specific requirements.** The provisions of [subpart A](/cfr/40/subpartA.md) of this part apply to this section except as modified by this [paragraph (b)](#b).
  - (1) **Recordkeeping.** Recordkeeping requirements as specified in § [721.125(a) through (c)](/cfr/40/721.125.md?p=a..c) and [(f) through (k)](/cfr/40/721.125.md?p=f..k) are applicable to manufacturers and processors of this substance.
  - (2) **Limitations or revocation of certain notification requirements.** The provisions of [§ 721.185](/cfr/40/721.185.md) apply to this section.
  - (3) **Determining whether a specific use is subject to this section.** The provisions of [§ 721.1725(b)(1)](/cfr/40/721.1725.md?p=b-1) apply to [paragraph (a)(2)(ii)](#a-2-ii) of this section.
