# §711.9. Persons not subject to this part.


A person described in [§ 711.8](/cfr/40/711.8.md) is not subject to the requirements of this part if that person qualifies as a small manufacturer or small government as those terms are defined in [40 CFR 704.3](/cfr/40/704.3.md). Notwithstanding this exclusion, a person who qualifies as a small manufacturer or small government is subject to this part with respect to any chemical substance that is the subject of a rule proposed or promulgated under TSCA section [4](/cfr/40/4.md), [5(b)(4)](/cfr/40/5.md?p=b-4), or [6](/cfr/40/6.md), or is the subject of an order in effect under TSCA section [4](/cfr/40/4.md) or [5(e)](/cfr/40/5.md?p=e), or is the subject of relief that has been granted under a civil action under TSCA section [5](/cfr/40/5.md) or [7](/cfr/40/7.md).
