# §63.6604. What fuel requirements must I meet if I own or operate a stationary CI RICE?

- (a) If you own or operate an existing non-emergency, non-black start CI stationary RICE with a site rating of more than 300 brake HP with a displacement of less than 30 liters per cylinder that uses diesel fuel, you must use diesel fuel that meets the requirements in [40 CFR 1090.305](/cfr/40/1090.305.md) for nonroad diesel fuel.
- (b) Beginning January 1, 2015, if you own or operate an existing emergency CI stationary RICE with a site rating of more than 100 brake HP and a displacement of less than 30 liters per cylinder that uses diesel fuel and operates for the purpose specified in [§ 63.6640(f)(4)(ii)](/cfr/40/63.6640.md?p=f-4-ii), you must use diesel fuel that meets the requirements in [40 CFR 1090.305](/cfr/40/1090.305.md) for nonroad diesel fuel, except that any existing diesel fuel purchased (or otherwise obtained) prior to January 1, 2015, may be used until depleted.

- (d) Existing CI stationary RICE located in Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, at area sources in areas of Alaska that meet either [§ 63.6603(b)(1)](/cfr/40/63.6603.md?p=b-1) or [§ 63.6603(b)(2)](/cfr/40/63.6603.md?p=b-2), or are on offshore vessels that meet [§ 63.6603(c)](/cfr/40/63.6603.md?p=c) are exempt from the requirements of this section.
