# §63.650. Gasoline loading rack provisions.

- (a) Except as provided in [paragraphs (b) through (d)](#b..d) of this section, each owner or operator of a Group 1 gasoline loading rack classified under Standard Industrial Classification code 2911 located within a contiguous area and under common control with a petroleum refinery shall comply with [subpart R](/cfr/40/subpartR.md) of this part, §§ [63.421](/cfr/40/63.421.md), [63.422(a) through (c)](/cfr/40/63.422.md?p=a..c) and [(e)](/cfr/40/63.422.md?p=e), [63.425(a) through (c)](/cfr/40/63.425.md?p=a..c) and [(e) through (i)](/cfr/40/63.425.md?p=e..i), [63.427(a)](/cfr/40/63.427.md?p=a) and [(b)](/cfr/40/63.427.md?p=b), and [63.428(b)](/cfr/40/63.428.md?p=b), [(c)](/cfr/40/63.428.md?p=c), [(g)(1)](/cfr/40/63.428.md?p=g-1), [(h)(1) through (3)](/cfr/40/63.428.md?p=h-1..h-3), and [(k)](/cfr/40/63.428.md?p=h-k).
- (b) As used in this section, all terms not defined in [§ 63.641](/cfr/40/63.641.md) shall have the meaning given them in [subpart A](/cfr/40/subpartA.md) or in [40 CFR part 63](/cfr/40/part63.md), subpart R. The [§ 63.641](/cfr/40/63.641.md) definition of “affected source” applies under this section.
- (c) Gasoline loading racks regulated under this subpart are subject to the compliance dates specified in [§ 63.640(h)](/cfr/40/63.640.md?p=h).
- (d) If a flare is used as a control device, on and after January 30, 2019, the flare shall meet the requirements of [§ 63.670](/cfr/40/63.670.md). Prior to January 30, 2019, the flare shall meet the applicable requirements of [subpart R](/cfr/40/subpartR.md) of this part, or the requirements of [§ 63.670](/cfr/40/63.670.md).
